1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and Connection Holdings, LLC, doing business as Home Direct Marketing ("HDM", "we", "us"). By accessing this site (apply.homedirectmarketing.com) or submitting an application through it, you agree to these Terms. If you do not agree, do not use the site.
2. Eligibility
By using this site you represent and warrant that you are at least 18 years old, have the legal authority to enter into these Terms on behalf of yourself and any business you represent, and are not prohibited from receiving our services under the laws of any applicable jurisdiction.
3. The affiliate application
This site allows marketing professionals and businesses to apply to join our affiliate network. Submitting an application:
- Is free of charge and creates no financial obligation
- Does not create an affiliate, partnership, employment, or agency relationship between you and HDM
- Does not obligate HDM to accept your application or respond within any particular timeframe
If your application is accepted, we will provide you with a separate Affiliate Agreement that governs the actual commercial relationship. The Affiliate Agreement controls in the event of any conflict with these Terms.
4. Accuracy of information
You agree to provide accurate, current, and complete information on the application form and to promptly update it if it changes. Misrepresentation of identity, traffic sources, prior networks, or marketing methods is grounds for immediate rejection of your application or termination of any resulting affiliate relationship, without notice.
5. Acceptable use
You agree not to:
- Submit false, misleading, or fraudulent information
- Submit applications on behalf of any person or entity without their authorization
- Use automated means (bots, scripts, scrapers) to submit applications or access the site, except as permitted by our robots policy
- Attempt to bypass, disable, or interfere with security features, rate limits, or bot-detection measures
- Attempt to probe, scan, or test the vulnerability of the site or any associated systems without our prior written authorization
- Use the site for any unlawful purpose, or in a manner that infringes the rights of others
- Transmit viruses, malware, or any other malicious code
- Reverse-engineer or copy the site's source code beyond what is visible in your browser
6. Intellectual property
The site, including its design, text, graphics, logos, source code, and selection and arrangement of content, is owned by or licensed to HDM and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. "Home Direct Marketing," the HDM lightning-bolt logo, and "Connection Holdings" are trademarks of Connection Holdings, LLC or its affiliates. You may not use these marks without our prior written permission.
You retain ownership of the information you submit, but grant HDM a non-exclusive, royalty-free, worldwide license to use that information for the purposes described in our Privacy Policy.
7. Third-party services and links
The site integrates with and links to third-party services such as Cal.com, Mailgun, Zoho, and Cloudflare (see our Privacy Policy for the current list). These services are governed by their own terms and privacy policies, and HDM is not responsible for their conduct or content.
8. Privacy
Our Privacy Policy describes what information we collect from you and how we use it. By using this site you also agree to our Privacy Policy.
9. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the site will be uninterrupted, error-free, secure, or free of harmful components. Any estimates of earnings potential or lead quality on the site or in marketing materials are for illustration only and do not constitute a representation or guarantee of actual results.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HDM AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR USE OR INABILITY TO USE THE SITE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR IN CONNECTION WITH THE SITE; OR (c) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT WILL HDM'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THIS SITE EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. To the extent an exclusion or limitation cannot be enforced, it will apply to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless HDM and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your breach of these Terms, (b) your violation of any law or the rights of a third party, or (c) any information you submit to us that is false, misleading, or infringes a third party's rights.
12. Termination
We may suspend or terminate your access to the site at any time, with or without notice, for any reason — including violation of these Terms. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
13. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You and HDM agree that any action or proceeding arising out of or related to these Terms or the site will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows when this version became effective. Continued use of the site after changes constitutes acceptance of the updated Terms. Material changes will be communicated prominently on this page.
15. General
These Terms, together with our Privacy Policy and any Affiliate Agreement between us, constitute the entire agreement between you and HDM regarding your use of the site. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision does not waive our right to enforce it later. You may not assign these Terms without our written consent; we may assign them freely.
